Please read these terms and conditions (the ‘Terms and Conditions’) carefully. BY USING THE SITE, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS. These Terms and Conditions govern your use of, and any purchase from, the VANITY JEWELS BY SHAY, LLC Site, and constitute an agreement between you and VANITY JEWELS BY SHAY, LLC. VANITY JEWELS BY SHAY, LLC reserves the right to change or modify any of these Terms and Conditions or any policy or guideline of the Site at any time, and in its sole discretion. Any change or modification will be effective immediately upon posting of the revisions on the Site. Your continued use of the Site following the posting of its changes or modifications will constitute your acceptance of such changes or modifications. Therefore, you should frequently review these Terms and Conditions and any other applicable policies from time-to-time to understand the terms and conditions that apply to your use of the Site. If you do not agree to the amended terms, you must stop using the Site. Product Availability And Pricing To properly place an order you must send a message directly to me. The message that is sent out should answer all questions on the ordering questionnaire displayed on the website page. Please note that some items maybe on back order. If items are on back order you will be notified and provided an ETA before payment is processed. Please note that some items require a deposit. Please note that all personalized items will require 2 to 4 weeks to be completed. All personalized items must be paid in full and there are no refunds on personalized items unless the names or dates are incorrect. Pricing are subject to change with or without notice however once a price have been agreed upon and payment have been processed after properly placing your order there will be no increase/decrease in prices. PAYMENT By purchasing on this site you confirm that the Paypal account or credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the Paypal account or credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment we will not be liable for any delay or non-delivery. Payment can be made by Paypal or via your credit/debit card linked to your Paypal account. Also by any other methods that may be advertised on our website site ie. Cash App and Western Union. Information On Our Site VANITY JEWELS BY SHAY, LLC we make every attempt to ensure that our online catalog is as accurate and complete as possible. In order to give you the opportunity to view our products in great detail, some products may appear larger or smaller than their actual size in our photographs; and since every computer monitor is set differently, color and size may vary slightly. Our objective is to provide you with as much information and detail about your prospective purchase as possible so that you can see the beauty and shape of a particular item. RETURNS If you wish to return an item then you should email us at [email protected] to notify us of the return within 3 days of receiving the goods. You should make it clear if you require an exchange, credit note or refund for the item. Any items returned without prior notice in via email will not be accepted. You must take reasonable care of all Goods in your possession and return them to us, appropriately packaged to avoid damage, within 4 days from the cancellation date. We reserve the right to arrange collection, in which case you will be responsible for collection charges. We will refund the purchase price to you within 30 days of the cancellation notice but we reserve the right to charge a restocking fee and any other costs we incur in connection with the return of the Goods. Items should be returned in their original packaging to ensure they are adequately protected in transit. Items should be returned new, unused, and with all the tags still attached. Returns that are damaged or soiled will not be accepted and may or may not be sent back to the customer. FAULTY GOODS Goods are classified as faulty if they are received damaged, or where a manufacturing fault occurs within one month of purchase. Please note that items that are damaged as a result of wear and tear are not considered to be faulty. If you would like to exchange a faulty item, please be aware that we can only replace it for the same product in the same color and style, subject to availability. LATE RETURNS Goods returned outside of the above timeframes will not accepted and will or will not be returned to the customer. CUSTOMER DEFAULT If you: • give us any incorrect personal information, or • fail to make any payment when it is due, or • cancel any payment, or • become insolvent, or • commit any breach of these Terms • then, in any of those events, we have the right to cancel the Contract and recover possession of any Goods which have been supplied for which payment has not been received in full. FORCE MAJEURE We will not have any liability to you if we are prevented from performing any of our obligations on account of any circumstances beyond our reasonable control which includes, but is not limited to, extreme weather conditions, holidays, act of God, terrorism, war, strike or difficulty in obtaining materials and/or labour. In any of these circumstances we reserve the right to terminate the Contract.
